Defendant: James H. Bendyna, Jr., 40, Philadelphia, PA
Charges: Burglary 3rd degree, Attempted Theft, Criminal Mischief, Wearing a Disguise during the Commission of a Felony, Possession of Burglar Tools, Conspiracy 2nd.
Resume: Delaware State Police detectives have arrested a Philadelphia man after he was observed breaking into a store in Bear.
The incident occurred early in the morning of August 26th after state police detectives received information that a subject, later identified as James H. Bendyna of Philadelphia, may be enroute to Delaware to commit a burglary of a pharmacy in the Bear, DE area. Detectives set up surveillance on several pharmacies along the Route 40 corridor in Bear. At approximately 1:30 a.m. they observed a Dodge Charger with a Pennsylvania registration plate enter the Governor’s Square Shopping Center parking lot and proceed to the Rite Aid. It was then that Bendyna exited the vehicle and then proceeded to break the lock of the front door of the Rite Aid and make entry into the store. Bendyna remained in the store for a short period of time but did not remove any items. He then responded back to the vehicle which then exited the parking lot and fled onto Rt. 1northbound and then I-95 northbound. Bendyna was then stopped on I-495 northbound where he and a passenger, identified as a 45 year old Blackwood, NJ man, were taken into custody. Bendyna was arrested and charged with the above listed crimes. He was arraigned at JP Court 2 and committed to the Henry R. Young Correctional Institute for lack of $15,000.00 secured bail. The 45 year old New Jersey man was released without being charged.
