Suspect #1: Ivan Nesby, 32 yr. old male resident of Oakland

Suspect #2: Ethel Hands, 25 yr. old female resident of Oakland

Suspect #3: 17 year old juvenile male resident of Oakland


NARRATIVE:

On 5/23/10, at approximately 0155 hours, an officer was on patrol when he saw the attendant at Shell Gas Station (2900 N. Main St.) involved in a struggle with two subjects inside the gas station food mart. The officer approached and detained the two subjects, as well as two others who were with them.

The investigation revealed that the subjects had just stolen several cartons of cigarettes and had returned to steal more when the clerk attempted to prevent them from committing the theft. As the clerk did this, he was assaulted by two of the suspects as another suspect stole cigarettes. It was at this time that the officer observed the crime occurring and detained all four suspects. The clerk was not injured in the robbery. The fourth subject, who was with the others, was determined not to be involved in the crime and as was released at the scene.

Two suspects were taken to MDF and a juvenile was booked into juvenile hall.
