Steve Gesell, Commander
Ofc. 805.470.3216
Mbl: 805.591.0647

Date of Incident: May 13, 2010

Incident Location: 8600 Block Atascadero Ave., Atascadero

Time: 7:45 a.m.

Suspect: 11 year-old Juvenile/Name Withheld

Police responded to the 8600 block of Atascadero Avenue yesterday morning following a report of sound of single gunshot. Officers were unable to locate the origin. Today,at approximately 0745, police responded to the same location after residents reported hearing what they believed to be a gunshot once again.

The first officer on scene heard what he belived to be a second shot but was unable to determine the exact origin at that time. Additional officers responded and a perimeter was established with the the assitance of Atascadero State Hospital Police, a San Luis Obispo County Sheriff’s Deputy and a San Luis Obispo District Attorney’s Office Investigator.

Santa Rosa Elementary was advised and a lock-down was instituted as a precautionary measure while APD continued to search for the origin of the gunfire.

Following a door to door search, information was received leading investigators to a person of interest that resides in the immediate area. This person was cooperative with police and susequently consented to a search of his residence. He was excluded as a suspect.

Shortly before 3 p.m., officers made contact with residents of another home in the immediate area that had been vacant at the time officers were searching the area. Officers determined the shooter to be a 11 year old juvenile. The juvenile has confessed to firing the weapon outside his home yesterday as well as this morning. A large caliber handgun and ammunition was seized at the location. The child will be interviewed and released to his parents’ custody. Investigators will also be tasked with determining if any charges will be requested against the boy’s parents and/or guardians.

APD does not believe there are any victims at this juncture.

“The outcome here could have clearly been tragic. We’re hopeful these and other parents will take note and ensure their firearms are properly secured; especially when there are children in the house.” ~

Cmdr. Steve Gesell
